Intellectual Property Policy – Cheezurk
At Cheezurk, we provide a platform where creators can express themselves through custom-designed apparel and merchandise. While we celebrate creativity, we are committed to respecting and protecting intellectual property rights.
Users are strictly prohibited from uploading, creating, or selling content that infringes on copyrights, trademarks, or any other intellectual property rights.
A. Reporting Intellectual Property Infringement
We take all IP infringement claims seriously. If you believe your intellectual property has been used without your permission on our site, please submit a detailed infringement notice. Once verified, we will promptly remove or restrict access to the offending content.
Accounts involved in repeated violations will be permanently banned.
To file a claim, your notice must include:
- Description of the Infringed Work: Include the name, description, and registration number (if available).
- Details of the Infringing Material: Link to or identify the specific page(s) where the violation occurs.
- Your Contact Information: Full name, mailing address, phone number, and email.
- Statement Under Penalty of Perjury: A declaration that your claim is accurate and you are the rights holder (or authorized to act on their behalf).
- Signature: A physical or digital signature confirming the validity of the claim.
B. What Happens After a Valid Report
Once we receive and review a complete and valid infringement notice:
- The infringing content will be removed or disabled.
- The uploader will be notified of the removal.
- Repeat violations may lead to permanent account termination.
C. Submitting a Counter-Notice
If your content was removed in error, and you believe you have legal grounds to use it, you can submit a counter-notice including:
- Identification of Removed Content: Specify the content and its original URL or location on the Cheezurk site.
- Statement Under Penalty of Perjury: Affirm that the removal was a mistake or misidentification.
- Your Contact Details: Full name, address, phone number, and email.
- Jurisdiction Statement: Agree to the jurisdiction of the U.S. Federal District Court where you reside, or where Cheezurk is based (if outside the U.S.).
- Signature: Your physical or digital signature.
If the original complainant does not take legal action within 10–14 business days, we may reinstate the content.
